By accessing or using the Jungwell platform, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing the platform. These terms apply to all visitors, users, and others who access or use the service.
To use Jungwell, you must create an account with accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.
You must be at least 18 years old and have the authority to bind your organization to these terms. Each account is for a single organization; you may not share account access across unrelated entities.
You agree to use Jungwell only for lawful purposes and in accordance with these terms. You may not use the platform to transmit harmful, offensive, or illegal content; attempt to gain unauthorized access to other systems; interfere with or disrupt the platform or its infrastructure; or reverse-engineer any aspect of the service.
You are solely responsible for the customer data you upload to the platform and must ensure you have the right to process such data. You must comply with all applicable data protection laws, including obtaining necessary consents from your customers.
The Jungwell platform, including its design, features, code, and documentation, is owned by Jungwell and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the platform for its intended purpose during your subscription term.
You retain all rights to your customer data. By uploading data to Jungwell, you grant us a limited license to process and display that data solely for the purpose of providing the service to you. We do not claim ownership of your data and will not use it for any purpose beyond delivering the service.
Paid plans are billed in advance on a monthly or annual basis. All fees are non-refundable except as expressly stated in these terms or required by law. We reserve the right to modify pricing with 30 days' notice. Price changes will take effect at the start of your next billing cycle.
To the maximum extent permitted by law, Jungwell shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising out of or in connection with your use of the platform.
Our total liability for any claims arising under these terms shall not exceed the amount you paid to Jungwell in the twelve months preceding the claim. This limitation applies regardless of the theory of liability.
Either party may terminate the subscription at any time. Upon termination, your access to the platform will cease at the end of your current billing period. You may export your data before termination; after termination, we will delete your data within 30 days unless retention is required by law.
We reserve the right to suspend or terminate your account immediately if you violate these terms, engage in fraudulent activity, or if continued use poses a risk to the platform or other users.
We may revise these terms from time to time. Material changes will be communicated via email or through the platform at least 30 days before taking effect. Continued use of the platform after changes take effect constitutes acceptance of the revised terms.
These terms are governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any disputes arising under these terms shall be resolved in the state or federal courts located in Delaware.
